4. non-arrival/cancellation by the customer
4.1 It should be noted that a mediated guest accommodation or lodging contract is to be treated no differently than any other contract under the German Civil Code. Unless otherwise agreed in the concluded contract, a general statutory right of withdrawal, termination or revocation on the part of the guest is excluded. Irrespective of the time or reasons for canceling a booking, there is no right of withdrawal/cancellation and the owner's/agent's claim to payment remains unaffected.
4.2 The owner/organizer is obliged to act in good faith and will endeavor in the ordinary course of business to allocate the unused accommodation elsewhere.
4.3 If it is possible to allocate the accommodation elsewhere, the rental income from this shall be offset against the owner's/organizer's claim for payment. If this is not possible, 90% of the agreed total rental price shall be charged, taking into account the percentages developed by case law with regard to saved expenses, at least in the amount of the deposit.
We recommend that you take out travel cancellation/cancellation insurance.
4.4 Until the vacation apartment is rented to another party, the customer must pay the amount calculated in accordance with section 4.3 for the duration of the contract.
